1.

Introduction

Welcome to Dooond. These Terms of Service govern your access to and use of the Dooond website www.dooond.com.au and any related products, features, content, communications and services made available through the website (together, the Platform).

The Platform is owned and operated by Normality Technologies PTY LTD (Normality Technologies, Dooond, we, us or our).
By accessing or using the Platform, creating an account, or purchasing a subscription, you agree to these Terms of Service. If you do not agree, you must not use the Platform.

The Platform is intended for use in Australia only.

2.

Eligibility

You must be at least 16 years old to use the Platform.

If you are aged 16 or 17, you represent that you have the maturity and capacity to understand and agree to these Terms and to consent to the handling of your personal information, or that your parent or guardian has authorised your use where required.

If you access or use the Platform on behalf of a business or other organisation, you represent that you have authority to bind that business or organisation to these Terms.

Nature of the Platform

Dooond is a subscription-based platform.

Dooond is not a commission platform. Unless expressly stated otherwise in a separate written agreement, Dooond does not charge commission on transactions between users, service providers, businesses or third parties.

The Platform may allow users to discover information, connect with other users or providers, access tools, manage subscriptions, submit content, or use features made available from time to time. Unless expressly stated otherwise, Dooond is not a party to any separate arrangement, transaction or relationship between users and third parties.

4.

Accounts

  • You may be required to create an account to access some features of the Platform.
  • You must provide accurate, current and complete information and keep your account details up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, unless caused by our failure to take reasonable security measures.
  • You must notify us promptly if you become aware of any unauthorised use of your account or any security breach.

Subscription Services

Some parts of the Platform are available only through a paid subscription.

By purchasing a subscription, you agree to pay the fees, charges and applicable taxes displayed at checkout or otherwise communicated to you before purchase.

Unless otherwise stated on the Platform:

  • Subscription fees are shown in Australian dollars;
  • Subscriptions are billed in advance
  • Subscriptions renew automatically at the end of each billing cycle
  • You authorise us or our payment processor to charge your chosen payment method for recurring subscription fees until you cancel.

We may offer different plans, features, pricing structures, trial periods or promotional offers from time to time

Free Trials and Promotions

We may offer free trials, discounts, credits or promotional subscriptions.

If a free trial converts to a paid subscription, your paid subscription will begin at the end of the trial period unless you cancel before the trial ends.

We may modify or withdraw a free trial or promotion at any time, subject to applicable law.

Billing and Payment

You must provide a valid payment method to purchase a paid subscription.

You authorise us and our third-party payment processor to charge all subscription fees, renewals, taxes and other amounts payable in connection with your account.

If a payment fails, we may retry the payment, suspend access to paid features, or cancel your subscription if payment remains outstanding.

You are responsible for ensuring your billing information is current.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us using the details provided on the Platform.

Unless otherwise stated at the time of purchase, cancellation takes effect at the end of your current billing period. You will continue to have access to the paid features until the end of that billing period, and no further renewal fee will be charged after cancellation.

Deleting your account does not automatically cancel a paid subscription unless the Platform expressly states that it does.

Refunds

Except as required by law, including under the Australian Consumer Law, subscription fees are non-refundable once paid, including for unused time, change of mind, or failure to cancel before renewal.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth) or other laws that cannot lawfully be excluded.

If you are entitled to a remedy under the Australian Consumer Law, those rights apply in addition to any rights set out in these Terms.

10.

Acceptable Use

You must not use the Platform in a way that:

  • Is unlawful, misleading, deceptive, fraudulent or harmful;
  • Infringes another person’s rights, including intellectual property or privacy rights;
  • Harasses, threatens, abuses or defames another person;
  • Uploads or transmits malicious code, viruses or harmful material
  • Interferes with the operation, security or integrity of the Platform;
  • Scrapes, harvests, copies or extracts data from the Platform without our prior written consent;
  • Impersonates any person or entity or misrepresents your affiliation with any person or entity; or
  • Uses the Platform to develop or support a competing service using data or materials taken from the Platform.
11.

User Content

If you submit, upload, post, transmit or otherwise make content available through the Platform, you retain ownership of your content unless otherwise agreed.

You grant us a non-exclusive, worldwide, royalty-free, transferable licence to host, store, reproduce, adapt, publish, display, communicate and use that content to operate, provide, improve, secure and promote the Platform.

You represent that:

  • You own or control the necessary rights to your content;
  • Your content does not breach any law or third-party right
  • Your content is not misleading, harmful or unlawful.

We may remove or restrict access to content if we reasonably believe it breaches these Terms, creates risk, or may expose us or others to liability.

Intellectual Property

All intellectual property rights in the Platform, including its software, branding, design, text, graphics, interfaces, databases, content and other materials, are owned by or licensed to Normality Technologies PTY LTD unless otherwise stated.

You may use the Platform only as permitted under these Terms. Nothing in these Terms transfers any intellectual property rights to you.

Third-Party Services

The Platform may include links to or integrations with third-party websites, payment processors, software tools, analytics providers or other services.

Those third-party services operate under their own terms and privacy policies. We are not responsible for third-party services, content or practices except to the extent liability cannot be excluded by law.

Platform Availability

We may update, modify, suspend or discontinue all or part of the Platform at any time.

We do not guarantee that the Platform will always be available, uninterrupted, secure or error-free.

We handle personal information in accordance with our Privacy Policy and Cookie Policy.

Suspension and Termination

We may suspend, restrict or terminate your access to the Platform immediately if:

  • You breach these Terms;
  • Your payment is overdue;
  • Your conduct creates legal, operational, security or reputational risk;
  • We are required to do so by law; or
  • Continued provision of the Platform is no longer commercially viable.

Where appropriate, we may provide notice and an opportunity to remedy the issue before suspension or termination.

On termination, your right to use the Platform ceases immediately, but any provision of these Terms that is intended to survive termination will continue to apply.

Disclaimers

To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis.

We do not guarantee that the Platform will meet your requirements or that your use of the Platform will produce any particular business, commercial or other outcome.

Any information made available through the Platform is general information only unless expressly stated otherwise and is not legal, financial or professional advice.

Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the maximum extent permitted by law, where liability cannot be excluded but can be limited, our liability is limited, at our option, to:

  • Resupplying the relevant services; or
  • Paying the cost of having the relevant services resupplied.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, business opportunity, goodwill, data or anticipated savings.

To the maximum extent permitted by law, our aggregate liability arising from or in connection with the Platform or these Terms will not exceed the amount you paid to us for the relevant subscription in the 12 months before the event giving rise to the claim.

19.

Indemnity

To the maximum extent permitted by law, you indemnify Normality Technologies PTY LTD and its officers, employees, contractors and agents against loss, damage, liability, cost and expense arising from your breach of these Terms, unlawful conduct or infringement of any third-party rights.

This indemnity does not apply to the extent the loss was caused by our negligence, fraud or breach of law.

Changes to the Platform or Terms

We may update the Platform and these Terms from time to time.

If we make a material change to these Terms, we may notify you by posting the updated Terms on the Platform, by email, through your account, or by another appropriate method.

Your continued use of the Platform after the updated Terms take effect means you accept the revised Terms.

21.

Governing Law

These Terms are governed by the laws of Australia and the laws of the State or Territory in which Normality Technologies PTY LTD is established.

You submit to the non-exclusive jurisdiction of the courts of that State or Territory and the courts of Australia.
